Welcome to LAYR ("LAYR", "we", "us", or "our").

These Terms of Service ("Terms") govern your access to and use of our website, products, and services available through our Shopify store (collectively, the "Services").

By visiting our website, creating an account, placing an order, or otherwise using our Services, you agree to be bound by these Terms, together with our Privacy Policy, Shipping Policy, and Return & Refund Policy.

Nothing in these Terms limits or excludes any mandatory rights that consumers have under applicable law.

SECTION 1 – ELIGIBILITY AND ACCOUNT

SECTION 2 – PRODUCTS

We specialize in the design and sale of high-quality 3D-printed products and accessories.

While we strive to display our products as accurately as possible, please note that:

  • colors may appear differently depending on your screen or device;
  • slight differences in finish, texture, layer lines, and color may occur due to the nature of the 3D printing process;
  • minor cosmetic variations are normal manufacturing characteristics and do not constitute defects.

Unless expressly stated otherwise, product images are intended for illustrative purposes only. Accessories, electronic devices, or decorative items shown in photographs are not included unless specifically mentioned in the product description.

We reserve the right to modify product specifications, materials, colors, packaging, or designs without prior notice, provided such changes do not materially affect the functionality of the product ordered.

We may discontinue products at any time.

SECTION 3 – PRODUCT COMPATIBILITY

Many of our products are designed to fit specific devices, accessories, furniture, or other products.

Customers are responsible for verifying compatibility before placing an order by reviewing the product description, dimensions, and specifications.

If you are unsure whether a product is compatible with your intended use, please contact us before ordering.

We are not responsible for incompatibility resulting from incorrect customer selection or use with products outside the stated specifications.

SECTION 4 – ORDERS

Placing an order constitutes an offer to purchase our products.

An order is not legally accepted until you receive an order confirmation email from us.

We reserve the right to refuse, cancel, or limit any order, including but not limited to situations involving:

  • suspected fraud;
  • pricing or technical errors;
  • product availability issues;
  • violations of these Terms.

If payment has already been received for a cancelled order, a full refund will be issued using the original payment method.

Please carefully review your order before submitting it. Once production or fulfillment has begun, changes or cancellations may no longer be possible.

Your statutory consumer rights, including any applicable right of withdrawal, remain unaffected.

SECTION 5 – PRICES AND PAYMENT

All prices displayed in our store include Value Added Tax (VAT) where applicable unless clearly stated otherwise.

Shipping costs, if applicable, are calculated and displayed during checkout before payment is completed.

We reserve the right to modify prices at any time. Price changes do not affect orders that have already been accepted.

Payment must be successfully completed before an order is processed.

We accept the payment methods made available during checkout through Shopify Payments and any other payment providers displayed at checkout.

You agree that all payment information provided is accurate and that you are authorized to use the selected payment method.

If payment authorization fails or is declined, we may cancel the order.

SECTION 6 – SHIPPING AND DELIVERY

Shipping times displayed on our website are estimates only and are not guaranteed.

Delivery may occasionally be delayed due to circumstances beyond our reasonable control, including but not limited to:

  • carrier delays;
  • customs inspections;
  • severe weather;
  • public holidays;
  • supply chain disruptions;
  • force majeure events.

We are not liable for delays caused by shipping carriers or circumstances outside our reasonable control.

For consumers, the risk of loss or damage passes to you only when you, or a person designated by you (other than the carrier), has taken physical possession of the goods.

SECTION 7 – RETURNS, REFUNDS AND RIGHT OF WITHDRAWAL

Returns, refunds, exchanges, and your statutory right of withdrawal are governed by our Return & Refund Policy.

Nothing in these Terms limits your mandatory rights under applicable consumer protection legislation.

If any provision of these Terms conflicts with mandatory consumer law, the applicable consumer law shall prevail.

SECTION 8 – INTELLECTUAL PROPERTY

All content available through our Services, including but not limited to text, graphics, logos, icons, images, product designs, product names, photographs, videos, 3D models, website design, layouts, and software, is owned by or licensed to LAYR and is protected by applicable copyright, trademark, design, and other intellectual property laws.

Nothing in these Terms grants you ownership of any intellectual property rights.

You may access and use our Services solely for your personal, non-commercial use.

Without our prior written permission, you may not:

  • copy or reproduce any content;
  • modify or create derivative works;
  • distribute, publish, or sell our content;
  • use our trademarks or branding;
  • use our product photos or marketing materials for commercial purposes;
  • reverse engineer or commercially exploit any part of our Services where prohibited by law.

Unauthorized use of our intellectual property may result in legal action.

Our online store is powered by Shopify, which provides the e-commerce platform that enables us to offer our products and Services.

However, all purchases made through our store are made directly with LAYR.

Shopify is not the seller of our products and is not responsible for:

  • fulfilling orders;
  • product quality;
  • returns or refunds;
  • customer support;
  • warranties;
  • any disputes relating to purchases made through our store.

To the extent permitted by applicable law, you agree that any claims relating to products purchased from our store shall be directed to LAYR and not to Shopify.

SECTION 12 – PRIVACY

Your privacy is important to us.

Our collection, use, storage, and protection of personal information are governed by our Privacy Policy.

By using our Services, you acknowledge that you have read our Privacy Policy.

As our store is hosted by Shopify, certain information is also processed by Shopify and its trusted service providers to operate and improve the Services.

SECTION 13 – REVIEWS, FEEDBACK AND USER CONTENT

If you submit reviews, comments, suggestions, photographs, or other content ("User Content") to us, you grant LAYR a worldwide, non-exclusive, royalty-free, perpetual license to use, reproduce, publish, modify, translate, distribute, and display that content for purposes including:

  • customer support;
  • marketing;
  • social media;
  • website content;
  • product improvements.

You retain ownership of your User Content.

You represent that:

  • you own or have permission to submit the content;
  • your content does not infringe third-party rights;
  • your content is accurate and lawful;
  • your content is free from malware or malicious code.

We reserve the right, but are not obligated, to remove User Content that we reasonably consider unlawful, offensive, misleading, abusive, defamatory, fraudulent, or otherwise inappropriate.

To the maximum extent permitted by law, LAYR shall not be liable for indirect, incidental, consequential, special, or punitive damages, including loss of profits, loss of revenue, loss of data, business interruption, or loss of goodwill arising from the use of our Services or products.

Our total liability relating to any order shall not exceed the amount paid by you for the product giving rise to the claim, except where applicable law provides otherwise.

Nothing in this section affects your statutory rights as a consumer.

SECTION 17 – FORCE MAJEURE

We shall not be liable for any delay or failure to perform our obligations under these Terms where such delay or failure results from circumstances beyond our reasonable control, including but not limited to:

  • natural disasters;
  • fire;
  • flood;
  • pandemic or epidemic;
  • war or armed conflict;
  • terrorism;
  • governmental actions;
  • strikes or labour disputes;
  • interruptions in transportation;
  • supply chain disruptions;
  • power outages;
  • failures of telecommunications or internet services.

Where such circumstances occur, we will make reasonable efforts to fulfil our obligations as soon as reasonably possible.

SECTION 18 – TERMINATION

We reserve the right to suspend or terminate your access to our Services if you violate these Terms or engage in unlawful, fraudulent, abusive, or harmful conduct.

Termination does not affect any rights or obligations that arose before the termination date.

The provisions relating to intellectual property, limitation of liability, governing law, dispute resolution, indemnification, and any provisions intended by their nature to survive termination shall remain in effect after termination.

This obligation applies only to the extent permitted under applicable law and does not affect your mandatory consumer rights.

The remaining provisions shall continue in full force and effect.

SECTION 22 – ENTIRE AGREEMENT

These Terms, together with our Privacy Policy, Shipping Policy, Return & Refund Policy, and any other policies expressly referenced herein, constitute the entire agreement between you and LAYR regarding your use of our Services.

They supersede any previous agreements or communications relating to the same subject matter.

SECTION 23 – ASSIGNMENT

You may not assign, transfer, or otherwise dispose of your rights or obligations under these Terms without our prior written consent.

We may assign or transfer our rights and obligations under these Terms where permitted by applicable law, including in connection with a business transfer, merger, acquisition, or sale of assets.

SECTION 24 – GOVERNING LAW

These Terms shall be governed by and interpreted in accordance with the laws of the Netherlands.

If you are a consumer residing in another Member State of the European Union, you also benefit from any mandatory consumer protection provisions that apply in your country of residence.

Nothing in these Terms limits those mandatory legal rights.

SECTION 25 – DISPUTE RESOLUTION

If you have a complaint regarding our products or Services, we encourage you to contact us first so we can work together to find a satisfactory solution.

Where required by applicable law, consumers residing within the European Union may also have access to alternative dispute resolution procedures.
